These Terms & Conditions (“Terms”) govern your access to and use of our website ecare.digityze.asia (the “Platform”), which connects clients (“Buyers”) and professional service providers (“Sellers”) offering home care, elderly care, and mother & baby care services.
By accessing or using our Platform, you agree to comply with and be bound by these Terms. Please read them carefully before using our services.
1. Acceptance of Terms
By creating an account, browsing, or using our services, you agree to these Terms and our Privacy Policy (collectively, the “Agreement”).
If you do not agree, please discontinue using the Platform immediately.
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use our Platform.
Service providers may be required to submit identity verification and relevant qualifications as part of our registration process.
3. Services Overview
eCare provides an online platform that:
- Allows Buyers to discover, compare, and book care-related services.
- Allows Sellers (caregivers, nurses, support staff) to offer their professional services.
- Facilitates communication and payment between both parties.
We are not a direct employer or care agency. All services are performed independently by the respective service providers.
4. User Accounts
Users must provide accurate and up-to-date information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
You must immediately notify us of any unauthorized use or security breach.
eCare reserves the right to suspend or terminate accounts that violate these Terms or our policies.
5. Service Bookings and Payments
All bookings and payments must be made through the Platform’s official channels.
Buyers agree to pay the total service fee as displayed at the time of booking.
Sellers will receive payments after service completion, subject to platform fees or commissions.
Refunds, cancellations, or disputes will follow our Refund Policy or case-by-case resolution.
6. User Conduct
By using our Platform, you agree not to:
Misrepresent your identity, skills, or service capabilities.
Post false, misleading, or inappropriate content.
Harass, abuse, or discriminate against other users.
Attempt to hack, disrupt, or misuse the Platform.
Circumvent payment systems to avoid platform fees.
Violations may lead to account suspension or permanent removal.
7. Platform Responsibilities
We strive to maintain a safe, reliable, and user-friendly platform.
However, eCare does not guarantee:
- The quality, safety, legality, or accuracy of services offered by Sellers.
- Continuous or error-free operation of the Platform.
- Outcomes resulting from interactions between Buyers and Sellers.
All users engage and transact at their own discretion and risk.
8. Fees and Commissions
eCare may charge service fees, commissions, or transaction costs for certain activities (e.g., completed bookings, premium listings).
All applicable fees will be displayed before confirmation and may be updated periodically with notice.
9. Reviews and Feedback
Users may leave feedback and ratings after completed services.
By submitting feedback, you grant eCare the right to display, use, and moderate such content.
We reserve the right to remove any feedback that violates our content policy.
10. Intellectual Property
All text, graphics, logos, software, and content on this Platform are the property of eCare or its licensors.
Users may not copy, reproduce, or distribute any part of the Platform without prior written consent.
11. Limitation of Liability
To the maximum extent permitted by law, eCare shall not be liable for:
- Any direct, indirect, or consequential losses arising from the use of the Platform.
- Any disputes, damages, or claims between Buyers and Sellers.
- Service interruptions or unauthorized access caused by third parties.
Your sole remedy for dissatisfaction with the Platform is to stop using it.
12. Indemnification
You agree to indemnify and hold harmless eCare, its directors, employees, and partners from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.
13. Termination
We may suspend or terminate access to your account at any time, without prior notice, for violations of these Terms or other policies.
Upon termination, your right to use the Platform ceases immediately.
14. Changes to the Terms
We may update or modify these Terms from time to time.
Any changes will be posted on this page with the updated date, and continued use of the Platform constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of Vietnam.
Any disputes shall be resolved through good faith negotiation, or if necessary, under the jurisdiction of competent courts in Ho Chi Minh City, Vietnam.
